أثر العرف في تغير الفتوى " فقه الأسرة أنموذجا
Résumé: كثيرا ما يتعارف الناس على معاملات وعادات تقوم عليها مصالحهم وحاجاتهم، فتأتي الشريعة بأحكام مناسبة تراعي فيها الظروف والأحوال المحيطة بكل واقعة، وقد يحدث أن تتغير تلك العوائد والأعراف لأسباب ما فيعيد المفتي نظره ويغيره فتواه حسب الظروف الجديدة التي تلبست بالواقعة، لتغير المصالح التي بنيت عليها تلك المعاملات العرفية. ويلاحظ في كتب الفقه، وجود أجوبة وفتاوى قد تفهم على أنها أحكام ثابتة ومستمرة ، وعند التحقيق يطلع على أنها فتاوى عرفية، جاءت في زمان ومكان معين وفي حال خاص وقد تتغير. فالفتاوى المبنية على العرف ليست ثابتة، كما أنّ الأحكام المبنية على العرف تدور معه وجودا وعدم. ومن أخص المجالات في هذا الباب والتي تراعى فيها الأعراف وقد تتغير وتتبدل فقه الأسرة، كخدمة الزوج، واشتراط البكارة، والطلاق الثلاث بفم واحد. Abstract People's transactions and customs take account of their interests, And it has provisions in Islamic law, If the customs change, the judgment changes, and The Mufti changes his judgment according to changing circumstances Because the interests of people also change , We must be aware of the existence of fatwas that we consider permanent, based on customs, and may change according to the change of interest.
