الرقابة القضائية على سلطات الضبط الإداري في مجال البناء والتعمير

Résumé: تتمتع الإدارة بسلطة واسعة في فرض القواعد العمرانية ، بهدف الحفاظ على النظام العام العمراني ،لكن حتى لا تتعسف في استعمال سلطاتها في مجال إصدار القرار الإداري المتضمن احد عقود التعمير منحت لسلطة أخرى الرقابة على تلك الإجراءات والمتمثلة في السلطة القضائية ،فالقاضي الإداري يراقب مدى احترام الإدارة لتلك الشروط،ويكون ذلك عن طريق رقابة قضائية والمتمثلة في دعوى الإلغاء ودعوى التعويض.
