المنھج الأصولي عند الفقیه محمد یحیى الولاتي (1259ه/1843م - 1330ه/1912م)

Résumé: This study was called : The fundamentalist approach of the jurist Mohammad yahya Al- wallati , may Allah have mercy on him (1330 AH -1912) which is a systematic study aimed at extracting the most important methods taken by the jurist in his fundamentalist research and highlighting its most important features , and thus showing The nature of the fundamentalist mind casts a shadow on many of the jurisprudence issuses of the era of Al- wallati . It also aims at introducing him and highlighting his position among the scientists of jurisprudence and the scientific value of his writings , and this is by answering a general question which is : what are the most important research methods pursued by the jurist (Al- wallati ) in his fundamentalist research and its most important features ? . Other sub – questions are built on this question such as : what is the nature of the fundamentalist composition of Al-wallati ? was it an independent edition Or just explanation and footnotes ? what are his most important fundamentalist writings and its scientific value ? Did it have an impact on the fundamentalist lesson after him or not ? To answer these questions , I relied on a combined approach of the historical, inductive and descriptive analytical method. I divided this research into an introduction and a preface , in which I showed what is meant by the fundamentalist approach in this study , and seven (7) chapters and a conclusion . In the first chapter , I introduced Introducing the era and the personal and scientific life of the jurist ( Al-wallati ) . In the second and third chapter , I introduced his most important and fundamentalist writings ( explanations and independent writings ). In the fourth chapter , I presented and showed his method in portraying of the fundamentalist issues through showing the most important approach which he followed in introducing the issues and thin exemplification . As for the fifth chapter , I spoke about his approach in explaining , editing and presenting the opinions of scientists . As for the sixth chapter , I devoted it to show his method of reasoning and quoting the speech of the scientists. finally , I ended the research with a seventh chapter in which I highlighted his methods in the fundamentalist his methods in the fundamentalist discussions and the most correct statement as well as extracting the fundamentalists. وسمت ھذه الدراسة ب: "المنھج الأصولي عند الفقیه محمد یحیى الولاتي (1259ه/1843م - 1330ه/1912م)"، وھي عبارة عن دراسة منھجیة تھدف إلى استخلاص أھم المناھج البحثیة التي سلكھا الفقیه الولاتي في بحثه الأصولي و إبراز أھم معالمھا، و من ثم بیان طبیعة العقل الأصولي المخیم بظلاله على كثیر من نوازل عصر الولاتي رحمه لله. كما تھدف أیضا إلى التعریف به، و إبراز مكانته بین علماء الأصول، و بیان القیمة العلمیة لأھم مؤلفاته الأصولیة؛ و ذلك من خلال الإجابة عن تساؤل عام، و ھو: ما ھي أھم المناھج البحثیة التي انتھجھا الفقیه الولاتي - رحمه لله - في بحثه الأصولي؟ و ما ھي أھم معالمھا؟ و قد انبنى على ھذا التساؤل تساؤلات فرعیة أخرى، و ھي: ما طبیعة التألیف الأصولي عند الولاتي؟ ھل كان تألیفا مستقلا، أو عبارة عن شروحات و حواشي فقط؟ و ما ھي أھم مؤلفاته الأصولیة؟ و ما قیمتھا العلمیة؟ و ھل كان لھا أثر في الدرس الأصولي أم لا؟ و قد اعتمدت للإجابة عن ھذه التساؤلات المنھج الوصفي القائم على التحلیل و الاستقراء، حیث قمت بتتبع مضامین مختلف مؤلفات الفقیه الولاتي الأصولیة و غیر الأصولیة؛ للوقوف على أھم مناھجه البحثیة في تقریب علم الأصول، و استخلاص أھم ملامحھا. إضافة للمنھج التاریخي الذي ظھر في الفصل المخصص لعصر و حیاة الفقیه الولاتي رحمه لله. و قد قسمت ھذا البحث إلى: مقدمة، و تمھید بینت فیه المقصود بمنھج البحث الأصولي في ھذه الدراسة، و سبعة فصول، و خاتمة. تناولت في الفصل الأول التعریف ببلاد و عصر و حیاة الفقیه محمد یحیى الولاتي - رحمه لله - الذاتیة و العلمیة. و في الفصلین الثاني و الثالث عرفت بأھم مؤلفاته الأصولیة (الشروحات و التآلیف المستقلة). و في الفصل الرابع تعرضت لبیان منھجه في تصویر المسائل الأصولیة، من خلال بیان أھم ما سلكه من مناھج في التعریف بالمسائل و التمثیل لھا. أما الفصل الخامس فتحدثت فیه عن منھجه - رحمه لله - في شرح و تحریر المسائل الأصولیة و عرض آراء العلماء فیھا. و أما الفصل السادس فخصصته لبیان منھجه في الاستدلال للمسائل الأصولیة، و الاستئناس بكلام العلماء. ثم ختمت بفصل سابع أبرزت فیه منھجه في المناقشات الأصولیة و بیان الراجح و كذا التخریج على الأصول.
