السلطة المحلية في الدستور التونسي لسنة 2014 The Local Authority In The Tunisian Constitution Of 2014

Résumé: تناولت الدراسة بيان مكانة السلطة المحلية في الدستور التونسي الصادر بتاريخ 27 جانفي 2014، ذلك أن التنظيم اللامركزي في تونس و لأول مرة جاء تحت تسمية "السلطة المحلية " عنوان الباب السابع من الدستور، وتعود أهمية هذه الدراسة إلى الدور الهام الذي تلعبه اللامركزية الإدارية في مجال تحقيق التنمية على المستويين الوطني والمحلي وتعزيز الديمقراطية المحلية . هدفت هذه الدراسة إلى الوقوف على كيفية تنظيم دستور 2014 للجماعات المحلية في تونس كتطبيق أصيل لفكرة اللامركزية الإدارية، وتعزيز مكانتها الدستورية، ذلك أن اللامركزية في تونس قد وقع تهميشها، في دستور غرة جوان 1959 حيث اتسم إطارها القانوني باللبس و الاقتضاب، فلم يذكر سوى هياكلها بصورة تكاد تكون عارضة . وقد خلصت الدراسة إلى أن الدستور التونسي لسنة2014 منح السلطة المحلية مكانة دستورية مرموقة مقارنة مع الدستور السابق والملغى، سواء من ناحية الموقع الدستوري المخصص لها أومن حيث المبادئ و المقومات الحديثة التي تقوم عليها . This study deals with the position of the local authority in the Tunisian Constitution of January 27th, 2014. For the first time the decentralized organization in Tunisia was entitled by “the local authority”, the title of Chapter VII from this Constitution. Hence the significance of the study stems from the important role which the decentralized administration plays in achieving of development at both levels national and local, also in the enhancing of the local democracy. Further this study aims to highlight how the Tunisian Constitution of 2014 has organized the local communities as an original application of idea of the decentralized administration. Moreover, it has strengthened its constitutional position. Given that the Constitution of June 01st,1959 has marginalized the decentralization, where its legal framework was too vague and brief.
