التسرب الإلكتروني كآلية لمكافحة الجريمة الإلكترونية في القانون الجزائري والفرنسي

Résumé: يعد التسرب الإلكتروني من الإجراءات المستحدثة للوقاية من الجرائم التي ترتكب باستعمال تكنولوجيات الإعلام والاتصال، ولقد أشار إليه المشرع الجزائري في قوانين خاصة، كالقانون رقم 20-05 المتعلق بالوقاية من التمييز وخطاب الكراهية، وأيضاً القانون رقم 20-15 المتعلق بالوقاية من اختطاف الأشخاص ومكافحتها، لكن رغم أهميته في الوقاية من الجريمة الإلكترونية، إلا أن المشرع الجزائري لم ينظمه كما فعل المشرع الفرنسي، فهو إجراء فتي، ما يزال في خطواته الأولى، وعليه ارتأينا توضيحه وتمييزه عن التسرب المادي والمراقبة الإلكترونية معتمدين في هذه الدراسة على التشريع الفرنسي والوقوف على النقائص الموجودة في القانون الجزائري. Electronic leakage is one of the new measures to prevent crimes committed using information and communication technologies. The Algerian legislator has referred to it in special laws, such as the law relating to the prevention of discrimination and hate speech. Also, the law related to preventing the kidnapping of people, but despite its importance in preventing electronic crime, However, the Algerian legislator did not regulate it as it did French legislature, as it is a young procedure, still in its first steps. Accordingly, we decided to clarify it and distinguish it from physical leakage and electronic monitoring, relying in this study on French legislation and identifying the shortcomings in Algerian law.
