إجراءات التحري و التحقيق في الجريمة الإلكترونية
Résumé: إن إجراءات البحث والتحقیق في الجنائي العام هي الأساس في البحث والتحقیق في جرائم الالكترونية تماما كما هو الحال في باقي الجرائم الأخرى، أما عناصر البحث والتحقیق الجنائي الأخرى من عملیة وفنیة وغیرها فإن استخدامها یتوقف على ظروف كل جریمة، فلما اعتمد المشرع الجزائري نصوصا لتجريم الأفعال الواقعة في الوسط الإلكتروني والمستخدم فيها الأجهزة الإلكترونية وكل ما يمس المعالجة الألية للمعطيات بمفهوم الجريمة الإلكترونية مما استدعى المشرع الجزائري الى ادخال مجموعة من التعديلات على كل من قانون العقوبات وقانون الاجراءات الجزائية، كما استحدث القانون 09-04 المتعلق بالقواعد الخاصة للوقاية من الجرائم المتصلة بتكنولوجيات الاعلام والاتصال ومكافحتها، اضافة الى القانون 18-04 المتعلق بالقواعد العامة للبريد والاتصالات الالكترونية، والقانون 18-07 المتعلق بحماية الأشخاص الطبيعيين في مجال معالجة المعطيات ذات الطابع الشخصي. الكلمات المفتاحية: إجراءات التحقيق الإلكتروني، الجريمة الإلكترونية، التفتيش، التسرب، الترصد الإلكتروني. Abstract : The procedures of research and investigation of the general criminal are the basis for the research and investigation of electronic crimes just as in other crimes, but the elements of research and criminal investigation of the general criminal process and other, its use depends on the circumstances of each crime, when the Algerian legislator adopted texts to criminalize the acts in the electronic environment and the use of electronic devices and all that affects the automated treatment of data in the concept of cybercrime, which necessitated the Algerian legislator to introduce a set of amendments to all amendments to all From the Penal Code and the Penal Procedure Act, Act 09.04 on special rules for the prevention and control of crimes related to information and communication technologies was introduced, in addition to Law 18.04 on the General Rules of Mail and Electronic Communications, and Law 18.07 on the protection of natural persons in the processing of personal data.
