ضمانات التمكين من الحق في التنمية

Résumé: يعد الحق في التنمية كحق من حقوق الجيل الثالث من أكثر طوائف حقوق الإنسان حداثة في أدبيات القانون الدولي لحقوق الإنسان وأكثرها جدلا، خاصة بعدما تبنته الأمم المتحدة باعتمادها إعلان الحق في التنمية عام1986، لذلك طرحت إشكالية مدى اعتباره حقا قائما بذاته في إطار منظومة حقوق الإنسان. لا يمكن للحق في التنمية أن يكرّس بمجرد طرحه بشكل نظري، وليس كافيا النّص على هذا الحق دوليا ودسترته وطنيا، بل لابّد من توفير الضمانات والشروط الكافية والكفيلة تضمن التمكين الفعلي للإنسان من هذا الحق في بيئـة تتساوى فيها الخيارات والفرص. وهنا تبرز أهمية وجود الضمانات كأحد المتطلبات والشروط الضامنة لمقاربة التّمكين من الحق في التنمية، والذي يعتبر الأرضية لتحقيق كافة حقوق الإنسان. وتقدم الدراسة الحالية التأسيس القانوني للحق في التنمية ودراسة مضمون وأبعاد الحق، والتي تعد الأرضية لدراسة ضمانات التمكين من الحق في التنمية ومدى تجسيدها واقعيا في ظل التحديات الدولية والوطنية الراهنة. ///////////////////////////////////////////////////////////////////////////////////////The right to development as a third-generation right is one of the most modern human rights denominations in the literature on international human rights law and the most controversial, Especially after the United Nations adopted it by adopting the Declaration on the Right to Development in 1986, and therefore posed a problematic extent of the right to be considered a stand-alone right within the framework of the human rights system. The right to development cannot form and crystallize by simply proposing it in theory. And it is not enough to recognize this right internationally, And include it in the constitution nationally, Rather, adequate and sufficient guarantees and conditions must be provided to ensure the effective empowerment of the human person from this right in an environment in which options and opportunities are equal. Here, the importance of safeguards emerges as one of the guarantor elements and conditions for the approach to empowering the right to development, which is the basis for achieving all human rights. The present study provides the legal establishment of the right to development and a study of the content and dimensions of the right, which is the basis for studying the guarantees of empowerment of the right to development and the extent of its realization in light of the current international and national challenges.
