تنفيذ العقوبة تحت نظام المراقبة الالكترونية في ظل التشريع الجزائري

Résumé: أصبح للعقوبة أغراض أخرى غير الأغراض التقليدية؛ حيث تتجه السياسة الجنائية نحو إصلاح الجناة وإعادة إدماجهم في المجتمع، لذا بدأ البحث عن تلك البدائل التي تحقق مصلحة الفرد ومصلحة المجتمع في آن واحد، تم اللجوء أولا إلى عقوبة النفع العام كبديل للعقوبة السالبة للحرية حيث أدخله المشرع الجزائري في قانون العقوبات طبقا للتعديل الذي أدخله عليه بقانون رقم 09-01 المؤرخ في 25 فبراير 2009، ثم التجأ إلى نظام المراقبة الالكترونية كآلية لتنفيذ العقوبة خارج المؤسسات العقابية وذلك بإدخال تعديل على قانون تنظيم السجون وإعادة الإدماج الاجتماعي للمحبوسين بقانون 18-01 المؤرخ في 30 يناير 2018، وذلك باستعمال سوار الكتروني يتم من خلاله مراقبة المحكوم عليه بواسطة جهاز مخصص لهذا الغرض. الكلمات المفتاحية: تنفيذ العقوبة، بدائل العقوبات، السوار الالكتروني، المراقبة الالكترونية، تكييف العقوبة. Abstract: Penalties have other purposes than traditional ones; criminal policy is geared towards reforming and reintegrating perpetrators into society, so the search for those alternatives that benefit both the individual and the community is beginning to be used. Algerian law in the Penal Code in accordance with the amendment made by Law No. 09-01 of 25 February 2009, and then resorted to the electronic monitoring system as a mechanism for the implementation of punishment outside the penal institutions through an amendment to the Law on the organization of prisons and social reintegration of those imprisoned by Law 18-01 Rook on January 30, 2018, using an electronic bracelet through which control sentenced by a dedicated device.
