مشروعية استعمال البصمة الوراثية في الإثبات الجنائي في التشريع الجزائري

Résumé: ملخص الدراسة : تبنت التشريعات الجنائية وسائل اثبات جنائية تقليدية كالشهادة واعتراف والمحررات ، ولكن هذه الوسائل لم تواكب التطور العلمي ، فظهرت وسائل اثبات علمية حديثة ، ومن أهمها البصمة الوراثية والتي أثارت جدل فقهي وقضائي بين معارض ومؤيد لاستعمالها في الإثبات الجنائي ، لكن المشرع الجزائري اجاز استعمالها بصفة عامة انطلاقا من حرية الاثبات ، وفي قانون خاص رقم 16- 03 الموافق 19 يونيو سنة 2016 ، المتعلق باستعمال البصمة الوراثية في الإجراءات القضائية والتعرف على الأشخاص ، لكنه لم يوضح حجيتها في الاثبات الجنائي وعليه تبقى خاضعة لقناعة القاضي الجنائي. : Study summary Criminal legislation adopted traditional criminal proof methods such as testimony, confession, and transcripts, but these methods did not keep pace with scientific development, so modern scientific proof methods appeared, the most important of which was the genetic fingerprint, which sparked a jurisprudential and judicial debate between opponents and supporters of their use in criminal evidence, but the Algerian legislator authorized their use in general on the basis of From the freedom of proof, and in a special law No. 16-03 corresponding to June 19, 2016, related to the use of the genetic fingerprint in judicial procedures and identification of persons, but it did not clarify its authority in criminal proof and therefore it remains subject to the conviction of the criminal judge :
