البصمة الوراثية ودورها في الاثبات الجنائي والمدني

Résumé: تسعى الورقة البحثية المقدّمة إلى تكوين إطلاع بشأن موضوع البصمة الوراثية، وسحبه إلى مجال المعالجة القانونية، ويتطلب ذلك إدراك الفجوة الشديدة بين الدول في مدى تمكنها من استعمال الأساليب الحديث في كشف الجرائم وتحديد المسؤولين عنها، وفي حماية حقوق المتهمين وسبل تحقيق العدالة في ذلك، بجعل البصمة الوراثية قرينة للبراءة. إنّ اعتماد أسلوب البصمة الوراثية يرسّخ أسلوب الردع العقابي، ويتصدى لحالة الإفلات من العدالة، كما أنّه يمنع التلاعب بالأدلة ويقلّل اللجوء إلى الشهود، كما يعمل على تسريع الفصل في القضايا أمام المحاكم، ويقلّل احتمالات التدليس أو الوشاية أو الاتهام الكاذب. ويتجه القضاء نحو النظر إلى البصمة الوراثية كسبيل لفك تعقيدات القضايا الاجرامية واثبات النسب والدفع بالبراءة. والجزائر باعتبارها بلدا مازال يسعى لتطوير منظومته القانونية هي في حاجة إلى إضفاء القانونية على هذا الخيار، وإدخال النصوص القانونية المنظّمة له في تشريعاتها، على نحو يوفّر النفقات ويحمي الحقوق، ويعطى المصداقية والثقة في أعمال القضاء الوطني. وتنتهي الورقة البحثية إلى استنتاج مفاده أنّ الوصول إلى الوضع المأمول بشأن اعتماد البصمة الوراثية يمر عبر تطوير التشريعات، وبتوفير مختبرات بحث وتحليل، وكذا إحداث تكوين للأفراد المختصين في مجال التعامل مع البصمة الوراثية على نحو مستمر.The paper seeks to configure and develop knowledge about the subject of genetic fingerprint , and study this subject in the field of legal treatment; this requires recognizing the deep gap between states in the extent ability to use modern methods in detecting crimes and identify those responsible, and in protecting the rights of the accused and achieving justice by making fingerprint genetic a proof of innocence. The adoption genetic fingerprint in the proof or acquittal reflects the complementary relationship between genetics and law, it also entrenches the method of punitive deterrence, and ending the case of impunity, under the conditions of scientific follow- up to the crime scene, use of genetic fingerprint prevents the manipulation of evidence, it also reduces the use of witnesses, expedites the adjudication of cases before courts, and reduces the likelihood of error or false accusation. The judiciary tends to look at fingerprint genetic as a effective way to deconstruct the complexities of criminal cases, prove the proportions and innocence.As a country that continues to seek to develop its legal system, Algeria needs to legalize genetic research,enter the legal texts about this in its legislation, in a manner that saves expenditure and protects rights, and gives credibility and confidence in the work of national justice. The paper ends with the conclusion that access to the hoped- for status of adoption of fingerprint genetic, it is achieved through the provision of research and analysis laboratories, as well as the formation of specialized personnel in the field of dealing with genetic fingerprint
