دور الإعذار في التحصيل الجبري لاشتراكات الضّمان الاجتماعي في التشريع الجزائري

Résumé: إن المكلّفين في مجال الضمان الإجتماعي أحيانا يتخلّفون عن تنفيذ التزاماتهم، مما يضطرّ هيئات الضمان الاجتماعي إلى اتخاذ اجراءات التحصيل الجبريّة المنصوص عليها في قانون 08/08 المتضمّن قانون منازعات الضّمان الاجتماعي، والمتمثلة في التحصيل عن طريق الجدول، الملاحقة، لمعارضة على الحسابات البريدية والبنكية الجارية والاقتطاع من القروض، غير أن المشرّع وضع قيدا لهيئة الضّمان الاجتماعي قبل اللّجوء إلى هذه الإجراءات، يتمثّل هذا القيد في الإعذار. إنّ أيّ إجراء تتخّذه هيئات الضّمان الإجتماعي ضدّ المكلّف دون إعذاره يترتّب عليه بطلان الإجراءات سالفة الذكر، بل واعتبارها كأنها لم تكن. وبالتالي فالمشرّع جعل الإعذار إجراء إجباريا قبل اللّجوء إلى أيّ طريق من طرق التحصيل الجبرية المنصوص عليها في قانون 08/08 والذي إن صحّ التعبير الاصطلاحي على هذا الإجراء بمقدّمات التحصيل الجبري لاشتراكات الضمان الاجتماعي. Abstract: The liable in the domain of social security sometimes fail to applicate their commitments, where force the social security organism to take the enforced recovery procedures set forth in law 08/08 containing law of social security disputes, and represented in the collection by the table prosecution, opposition to the mailing accounts and, current bank and deduction on loans, is that the legislator put a constraint to the social security organism before restoring to these procedures, this restriction is in notice. Any procedure is taken by social security organisms against the liable without notice , result in the invalidity of the above procedures, and even mind as if they weren’t. Thus, the legislator makes the notice a compulsory procedure before resorting to any of the methods of the enforced recovery setting forth in law 08/08 and I have made up to this measure by introductions of the enforced recovery to the social security contributions.
