التراخيص الاجبارية لبراءات الاختراع أداة للتنمية الاقتصادية

Résumé: ملخص: إن صاحب براءة الاختراع له الحق في استغلال براءته، وذلك خلال فترة زمنية حددها القانون، إلا أن هذا الاستغلال ليس مطلقا بل يخضع لقيود، إذ يمكن لأي شخص في أي وقت أن يحصل من المصلحة المختصة على رخصة بسبب عدم استغلال الاختراع أو نقص فيه حتى ولو كان صاحبها غير موافق وهذا ما يسمى بالتراخيص الإجبارية. ونظرا للأهمية البالغة التي يتميز بها موضوع التراخيص الإجبارية لبراءات الاختراع وأثره على الأطراف ( المرخص والمرخص له جبرا) وعلى الاقتصاد الوطني، جاء هذا البحث بهدف دراسة موضوع التراخيص الإجبارية مع تبيان كافة الجوانب المحيطة به والآثار القانونية المترتبة عليه. الكلمات المفتاحية: التراخيص الإجبارية؛براءة الاختراع ؛الاستغلال؛اتفاقية باريس؛ ملكية صناعية. Abstract: The owner of the patent has the right to exploit his patent, during a period of time specified by law, but this exploitation is not absolute but is subject to restrictions, if any person can at any time obtain from the competent authority a license because of non-exploitation of the invention or a deficiency in it even if its owner did not agree, and this is called compulsory licenses. In view of the great importance of the subject of compulsory licenses for patents and its impact on the parties and the national economy, this research came with the aim of studying the issue of compulsory licenses with an explanation of all the aspects surrounding it and the legal implications of it.
