التزام القاضي باحترام مبدأ المواجهة في القانون الجزائري

Résumé: الملخص : أحاول من خلال هذا الموضوع أن أدرس مبدأ المواجهة الذي نصت عليه المادة 3/3 من قانون الإجراءات المدنية و الإدارية و التي ألقت على عاتق الخصوم التزام تبادل العلم في الوقت المحدد بجميع اجراءات القضية التي يتخذها كل واحد من الأطراف لكي يتمكن من اتخاذ الإجراءات المناسبة بشأنها و دور القاضي هنا هو مراقبة مدى احترام الخصوم لهذه الالتزامات الواقعة على عاتقهم و فرضها عليهم اذا لم يلتزموا بها. و من جهة أخرى التزام القاضي. و من جهة أخرى التزام القاضي بهذا المبدأ الذي يظهر من خلال بعض الوسائل التي يستعملها في سير الدعوى كما جعل كما التزام القاضي يخضع للمراقبة و الاثبات. Abstract: Through this topic, I try to study the confrontation principle set out in article 3/3 of the Code of Civil Procedure, which places the litigants on the obligation to exchange knowledge in a timely manner of all proceedings taken by each of the parties in order to be able to take appropriate action on them. The role of the judge here is to monitor the extent to which the litigants respect and impose these obligations on them if they fail. On the other hand, the judge's commitment to this principle is manifested through certain means used in the conduct of the proceedings and has made the judge's obligation subject to monitoring and proof.
