أسس مبدأ الوجاهية في القضاء بين الفقه الإسلامي والقانون الجزائري Foundations Of The Principle Of Facing In The Judiciary Between Islamic Jurisprudence And Algerian Law

Résumé: يدرسُ هذا البحث مبدأ الوجاهية بين الخصوم أثناء التقاضي في الفقه الإسلامي والتشريع الجزائري، ويهدف إلى التعريف بمبدأ الوجاهية في القضاء وبيان مدى أهميته، وتأصيل النصوص الشرعية والقانونية المؤسسة لهذا المبدأ وبيان وجه دلالتها، كما يهدفُ إلى بيان وتفعيل العلاقة بين مواجهة الخصوم ومصداقية الحكم القضائي، وتحديد أثر التواجه بين الخصوم على رأي القاضي وتقديره للأحكام، ومن أهم نتائج البحث أنّ مبدأ الوجاهية من مبادئ تأسيس الأحكام في الشريعة والقانون، وهو مبدأ إجرائي يقوم على حضور الخصوم أو من ينوبهم أثناء المحاكمة، والهدف منه إضـفاء الشـفافية فـي التقاضـي، ويُعدّ من المناهج الأساسية في استقراء الأحكام، كما يؤثر في دقة الحكم القضائي. This research studies the principle of facing antagonists during litigation in Islamic jurisprudence and Algerian legislation. The research aims to introduce the principle of facing in the judiciary and to explain its importance, and to establish the jurisprudence and law texts that establish this principle and to explain its significance. It also aims to clarify and activate the relationship between facing antagonists and the credibility of the judicial ruling, and to determine the impact of this facing on the judge’s opinion and his assessment of the judgments. Among the most important results of the research is that the principle of facing is one of the principles of establishing rulings in Sharia and law, and it is a procedural principle based on the presence of the litigants or their representatives during the trial. Its aim is to add clarity in litigation. It considered one of the basic methods for extrapolating rulings, and it affects the accuracy of judicial judgment
