المسؤولية المدنية عن أضرار التلقيح الالزامي

Résumé: ملخص: ان أغلب التشريعات تقوم بفرض اجراء تلقيحات دورية على بعض شرائح المجتمع ،إذ لايملك الشخص الحرية في القيام بالتلقيح أو عدم القيام به لأنه مفروض من قبل الدولة وذلك من أجل المصلحة العامة، ورغم تلك الفوائد الكبرى لعملية التلقيح غير انها لاتخلو من المخاطر والأضرار، و التشريع العراقي و على غرار باقي التشريعات العربية فقد اغفل الاشارة الى الأضرار الناتجة عن حوادث التلقيح الالزامي ولم تعالج كيفية تعويض المتضررين جراء ذلك، وفي غياب تنظيم تشريعي خاص لحكم المسؤولية عن تعويض هذا النوع من الأضرار فإنها تخضع للقواعد العامة للمسؤولية المدنية. Abstract: Most of the legislation is to impose a periodic vaccinations on some segments of society, as it does not possess the person freedom to artificial insemination or not to do because it is imposed by the State in the public interest, although those major benefits of vaccination process but risks and damage, and the Iraqi legislation, like the rest of the Arab legislations has overlooked the reference to damages resulting from incidents of compulsory vaccination and did not address how to compensate affected by it, and in the absence of the organization of special legislative rule of liability for compensation for this type of damage, they are subject to the general rules of civil liability
