الإطار القانوني لتشغيل الأجانب في الجزائر

Résumé: الملخص: تعمل مختلف الدول في العالم على تضمين قوانينها الداخلية نصوصا تنظم بموجبها موضوع تشغيل الأجانب ، قصد تنظيم سوق الشغل و ذلك بوضع نظام قانوني معتدل و متوازن حاولت من خلاله حماية اليد العاملة الوطنية من منافسة نظيرتها الأجنبية من جهة ، و تلبية حاجات اقتصادها من جهة أخرى. فمن خلال هذه الدراسة ، حاولنا عرض التجربة الجزائرية في مجال التنظيم القانوني لتشغيل الأجانب و ذلك من خلال تحليل النصوص القانونية التي سنها المشرع الجزائري سبيل تنظيم سوق تشغيل الأجانب ، و التي أظهرت أن المشرع الجزائري قد سعى جاهدا إلى وضع نظام قانوني معتدل و متوازن حاول من خلاله حماية اليد العاملة الوطنية من جهة ، و المحافظة على حقوق العمال الأجانب من جهة أخرى . الكلمات المفتاحية: العامل الأجنبي ، اليد العاملة الوطنية ، سوق الشغل ، عقد العمل ، الحقوق ، الإلتزامات. Abstract : The various countries in the world incorporat their domestic laws into provisions governing the employment of foreigners, in order to regulate their lab our market by establishing a moderate and balanced legal system through which it has tried to protect the national lab our force from competition with its foreign counterparts on the one hand, and to meet the needs of its economy on the other. Through this study, we tried to present the Algerian experience in the field of legal regulation of the employment of foreigners by analyzing the legal texts enacted by the Algerian legislator to regulate the foreign employment market, which showed that the Algerian legislator has strived to established a moderate and balanced legal system through which they tried to protect the national labor force on the one hand , and to preserve the rights of foreign workers on the other.
