Résumé: مع كثرة الابتكارات العميقة والمنافسة الشرسة والمشهد المتغير للرعاية الصحية، أصبح النفاذ إلى تكنولوجيا الصناعة الصيدلانية مسألة ملحة، ما أدى إلى زيادة حرص شركات صنع الأدوية على حماية سر ابتكاراتها واختراعاتها وبالأخص بيانات الاختبار، ومن هنا، وضعت التشريعات المقارنة حماية خاصة للبيانات والمعلومات السرية، تتضمن منع الغير من الاعتداء عليها؛ ومن ناحية أخرى تتيح قواعد المسؤولية التقصيرية والمنافسة غير المشروعة والمسؤولية العقدية، حماية فعالة للمعلومات السرية في الدول التي لا توجد فيها تشريعات خاصة توفر حمايتها. With the abundance of deep innovations, fierce competition and the changing landscape of healthcare, access to pharmaceutical industry technology has become an urgent matter, which has led to an increase in drugmaking companies ’keenness to protect the secret of their innovations and inventions, especially test data. Hence, comparative legislation has established special protection for confidential data and information, including Prevent others from assaulting them; On the other hand, the rules of tort, unfair competition and contractual liability also allow effective protection of confidential information in countries where there are no special legislation protecting it.
