الحماية الدولية للاختراعات الصيدلانية

Résumé: إن موضوع براءات اختراع الأدوية من أهم المسائل المطروحة بقوة على الساحة الدولية، خصوصا أن صناعة الأدوية تعتمد في الأساس على تركيبات كيميائية تفضّل شركات الأدوية المبتكرة لها حمايتها من خلال براءات الاختراع. وسنركز من خلال ورقتنا البحثية على الحماية القانونية لبراءة الاختراع الصيدلاني في ضوء أحكام إتفاقية تريبس، باعتبار أن براءة الاختراع في المجال الصيدلاني تعتبر وسيلة لحماية الاختراعات الصيدلانية والتي تمثل أهم حقوق الملكية الفكرية؛ وقد كفلت إتفاقية تريبس حماية خاصة لهذا النوع من الاختراع، حيث وضعت شروط لمنح البراءة سواء كانت شروط شكلية أو موضوعية، كما تمنح الحقوق لأصحاب براءة الاختراع لاستغلال اختراعه، غير أن هذه الحقوق مقيدة بقيود قانونية. Abstract: The issue of drug patents is one of the most important issues on the international stage, especially since the pharmaceutical industry relies primarily on chemical formulations that innovative drug companies prefer to protect through patents. Through our research paper, we will focus on the legal protection of the pharmaceutical patent in the light of the provisions of the TRIPS Agreement, considering that the patent in the pharmaceutical field is a way to protect pharmaceutical inventions that represent the most important intellectual property rights; To grant a patent, whether formal or substantive conditions, it also gives rights to patent owners to exploit its invention, but these rights are restricted by legal restrictions.
