التكييف الجزائي لانتهاك تدابير الوقاية من كوفيد-19 ومكافحته (دراسة على ضوء القانون رقم 20-06 المؤرخ في 28 أبريل سنة 2020 المعدّل والمتمّم لقانون العقوبات)

Résumé: الملخص: سرعان ما تحولت جائحة كورونا (كوفيد-19) من أزمة صحية إلى أزمة عامة مست مختلف المجالات، وكان وقعها على المجال القانوني واضح الأثر من خلال الترسانة القانونية التي صاحبت تطور الجائحة، فصدرت في البداية عدة مراسيم تنفيذية تكرس تدابير التباعد الاجتماعي وترمي إلى تقييد بعض الحقوق والحريات بالقدر اللازم للحد من انتشار فيروس كوفيد-19 بغرض المحافظة على أرواح الناس، غير أن استمرار الجائحة في الانتشار واستمرار الخسائر البشرية، استوجب الاستعانة بقواعد القانون الجنائي بتعديل وتتميم أحكام المادة 459 ق. عقوبات المتضمنة مخالفة المراسيم والقرارات الإدارية، واستحداث جريمة تعريض حياة الغير وسلامته الجسدية للخطر بموجب المادة 290 مكرر ق. عقوبات، كل ذلك في سبيل فرض احترام تدابير التباعد الاجتماعي بغرض وضع حد لانتشار جائحة كورونا، غير أن النصين المذكورين أعلاه قد يطرحان مشكلة التكييف الجزائي لانتهاك تدابير الوقاية من كوفيد-19 ومكافحته. Abstract: The covid-19 pandemic soon transformed from a health crisis to a general crisis that affected various fields, and its impact on the legal field was clearly influenced by the legal arsenal that accompanied the develepment of this pandemic, in the begining, several executive decrees were issued devoted to measures of social divergence and aimed at restricting some rights to the extent necessary to limit the spread of Covid-19 in order to preserve people’s lives, however, in order for the pandimic to continue to spread and the human losses to be sustained, it required the use of the criminal law to amend and supplement the provisions of article 459 of the Penal Code, which includes offense of violation of administrative decrees and decisions, and introducing the offense of endangering the lives and physical integrity of others (article 290 bis), all in order to impose respect social divergence measures to end the spread of corona pandemic, however the tow texts raise the problem of legal caracterization for violating covid-19 prevention and control measures.
