اشتغال الراوي في القضاء وأعمال السلاطين وأثره في الجرح والتعديل

Résumé: يَرْمِي هذا البحث إلى تحقيق القول في مسألة مهمة من مسائل الجرح والتعديل، تَهُمُّ كل مُشْتَغِلٍ بعلم ‏الحديث، ألا وهي أثر اشتغال الراوي بالقضاء, أو العمل للسلطان في حاله جرحا وتعديلا عند المحدثين.‏ وقد تضمَّن البحث تمهيداً يوضِّح مفهوم مصطلحات العنوان، ومبحثين في الجرح بسبب القضاء، ‏ومبحث أخير في الجرح بسبب الدخول على السلطان أو العمل له، وذلك من خلال جَمْعِ الأحاديث في الباب, ‏وأقوال أهل العلم حولها، وبيان ما تضمَّنته من أحكام شرعية تخصُّ موضوع الدراسة، وكذا جمعِ ما أمكن من ‏الرواة المتَكَلَّم فيهم بهذا الطعن, وتقويمه بعرضه على قواعد المحدثين في الجرح والتعديل, كما عُنِيَ البحث بربط ‏الجانب النظري بنظيره التطبيقي.‏ وقد خلُصَ البحث إلى أن الجرح بسبب القضاء أو السلطان ليس من قبيل الجرح القادح في الراوي ‏الثقة، إذا تجرَّد عن الوقوع في قوادحَ أخرى أثناء عمله، بدليل عدم اعتماد المحدثين عليه في تضعيف الرواة, أو ردِّ ‏رواياتهم, إضافةً إلى تنصيصهم على عدم اعتباره. ويُحمل الطعن على أنه قُصِدَ به أَوْجُهَ أخرى غيرَ الحكم على ‏الراوي في جانب الحديث.‏ ‏ This research aims to achieve a say on an important issue of issues criticism and praise "djareh and ta'adill" it is important for everyone interested in the science of Hadith, the effect of the judiciary and the work of the sultans in the case of the narrator " Narrated the hadeeth of the Prophet". The research included a prelude explains the concept of the terms of the title, and two parts in the criticism because of the judiciary, and divided into the criticism because of the work at the Sultan, and this through the collection of Hadeeths of the subject study, and the explanations of imams hadeeth to them, the statement of the legitimate provisions. Gather as many narrators as possible in this criticism, and modify it by introducing it to the rules of imams hadeeth on the criticism and praise. The research also related to the theoretical aspect of the application. and concluded that the criticism due to the judiciary or the Sultan is not counted alone
