التحكيم الإلكتروني في عقود التجارة الدولية

Résumé: For resolving the disputes of international trade contracts, the use of electronic arbitration is considered one of the most important reflections of technological progress on the reality of international trade arbitration. Therefore, the technological revolution being a reason behind the change in means of communication, has pushed the international trade traders’ thinking to use electronic means to resolve the raised disputes. So, they use electronic arbitration as a modern way of traditional arbitration. This method provides many advantages that no legal system provides for the resolution of disputes, including speed, effectiveness and low costs. However, it faces some difficulties due to the failure to keep pace with national legislation and international conventions on technological development because the lawmakers do not imagine the new issues resulted from this progress. يعد اللجوء للتحكيم الإلكتروني لحسم منازعات عقود التجارة الدولية أهم انعكاسات التقدم التكنولوجي على واقع التحكيم التجاري الدولي، فالثورة التكنولوجية و ما أحدثته من تغيير في وسائل الاتصال أدى لاتجاه فكر متعاملي التجارة الدولية لاستخدام الوسائل الالكترونية لحل المنازعات المثارة، و آية ذلك اللجوء لاستخدام التحكيم الإلكتروني باعتبا ره صورة حديثة للتحكيم التقليدي، و يوفر هذا الأسلوب العديد من المزايا التي لا يوفرها أي نظام قانوني لحل النزاعات من بينها السرعة و الفعالية و قلة التكاليف، إلا أنه يواجه بعض الصعوبات مرجعها عدم مواكبة التشريعات الوطنية و الاتفاقيات الدولية للتطور التكنولوجي بسبب عدم تخيل واضعيها ما سيفرزه هذا التطور من مستجدات.
