المعالجة القانونية للتسليم الإلكتروني في ظل التشريع الجزائري

Résumé: لمعالجة هذا المقال نركز على جزء من زاوية مهمة في تنفيذ التعاقد عن بعد ويتعلق الأمر بالتسليم الإلكتروني للمبيع وبشكله الرقمي أحيانا ، وهذا الإلتزام الرئيسي للبائع المحترف قد تأثر بالمعلوماتية ، وأصبح يكتسي معنى جديد ، بإعتبار أن عقد البيع الإلكتروني يشكل قلب التجارة الإلكترونية ، وفي بحثنا هذا سنحاول التركيز على أهم خصوصيات التسليم الإلكتروني بأنواعه الموجودة وطرقه العملية وإطاره القانوني إضافة إلى الإحاطة بالإشكالات القانونية الواردة عليه ، وطرق ضبطها بمنظور التشريع الجزائري في إطار القانون 18-05 الخاص بالتجارة الإلكترونية و بعض التشريعات المقارنة مع التركيز أيضا على المدد القانونية الواجب إحترامها في حالات فسخ العقد بإرادة المستهلك الإلكتروني ، و الآثار القانونية الناجمة عن ذلك . In this article, we will discuss a part of an important angle in the implementation of remote contracting and it is related to electronic delivery of the sale and in its virtual form Sometimes , and this main obligation of the professional seller has been affected by informatics and has acquired a new meaning, given that the electronic sales contract is the heart of electronic commerce, In our research, we will try to focus on the most important features of electronic delivery of its existing types scientifics methods and legal framework, In addition surrounding the legal problems and controlling them from the perspective of the Algerian legislation within the framework of Law 18-05 on E-commerce And some comparative legislations with a focus also on the legal periods that must be respected in cases of contract termination by the will of the electronic consumer and the resulting legal effects.
