العقود الذكية المدمجة في البلوك تشين: بداية نهاية العقود التقليدية

Résumé: الملخص: تتناول هذه الدراسة ظاهرة بروز نموذج تعاقدي جديد للتفاعل في الفضاء السيبراني يدعى العقد الذكي المدمج في البلوك تشين، الذي يعتبر أحد أهم الثورات القانونية التي ستشهدها المعاملات الإلكترونية، هذا البلوكتشين الذي يعتبر التقنية الكامنة وراء Bitcoin ، يسمح "للعقود الذكية" باستغلال إمكاناتها الكاملة، فيمكن لأي طرف ما إنشاء معاملاته تلقائيًا وبرمجة النتائج والآثار المحتملة التي تنشأ أثناء العلاقة التعاقدية مسبقًا. كما يمكن أن يضمن العقد الذكي أن العقد القانوني سيتم تنفيذه بشكل صحيح وتلقائي. ونتيجة لذلك، فإن البلوكتشين الذي يدعم العقود الذكية يوفر "عدالة آلية" من خلال أتمتة وتنفيذ العلاقات التعاقدية عن طريق ترميز هذه العلاقات عليه، وذلك بتزويد مستخدميه بالقدرة على ربط عدد لا يحصى من الظروف المحتملة بالنتائج المقابلة من خلال كود الكمبيوتر، وبدون أي تدخل لوسيط بشري. Abstract: This study deals with the phenomenon of the emergence of a new contractual model for interaction in cyberspace called the smart contract built into the Blockchain, which is considered one of the most important legal revolutions that electronic transactions will witness. This Blockchain, which is the technology behind Bitcoin, allows "smart contracts" to exploit their full potential. For any party to create its transactions automatically and pre-program the potential results and impacts that arise during the contractual relationship. A smart contract can also guarantee that the legal contract will be executed properly and automatically. As a result, the Blockchain that supports smart contracts provides "automated justice" by automating and implementing contractual relationships by encoding these relationships on it, by providing its users with the ability to link a myriad of potential circumstances to the corresponding results through computer code, without any mediator interference Human.
