عقود البلوك تشين من منظور قانون العقود

Résumé: استلام مبلغ التأمين على السفر دون تقديم طلب مسبق؛ الاستفادة من السكنات الموسمية دون وساطة وكيل سياحي من خلال شقة متصلة، الحصول على ضمان نظير تأدية خدمة معينة... كل هذا اصبح ممكنا مع استخدام تكنولوجيا عقود البلوك تشين Blockchain، أو كما تسمى عادة بـ "العقود الذكية": ترجمة حاسوبية على البلوك تشين لالتزام تعاقدي لضمان تنفيذه تلقائيا. تعتبر البلوك تشين قاعدة بيانات تسجل عليها جميع المبادلات وجميع العمليات التي يقوم بها مستخدموها منذ نشأتها، بحيث تكون مرتبطة مع بعضها بطريقة متسلسلة ومشفرة، وموزعة على مختلف العُقد المكونة للشبكة التي تدعمها. ان العقود الذكية في حد ذاتها ليست جديدًة، ولكنها وجدت مع البلوك تشين ديناميكية قد تضع حقوقنا موضع عدة تساؤلات. تهدف الدراسة الى التساؤل حول مدى تأثير العقود الذكية على قانون العقود. Smart contract in themselves are not new, but with Blockchain, tthey find a new dynamic that could put our rights in question. The purpose of this study is to question the impact of smart contracts on contract law.
