مطابقة أحكام التحكيم التجاري الدولي للنظام العام الدولي في القانون الجزائري والقانون الفرنسي -دراسة مقارنة-

Résumé: تُعدّ فكرة النظام العام ومدى احترامها مؤشر أساسي يستند عليه القاضي الوطني لقبول توغل حكم التحكيم التجاري الدولي في نظامه القانوني بالاعتراف به وتنفيذه على ترابه، فما هو تقييم رجال القانون لهذه الفكرة في مجال التحكيم، وما طبيعة وحدود الرقابة التي يمارسها القانون والقضاء للتأكد من مطابقة عمل المحكّمين لها. The concept of public order and the extent to which it is respected is a basic indicator on which the national judge relies on through the process of accepting the penetration of the international commercial arbitration in its legal system by recognizing and implementing it. Then, what would be the jurists’ evaluation/ judgement of this idea in the field of arbitration, and what are the nature and limits of the control exercised by the law and the judiciary to ensure that the arbitrators’ work conforms to it?
