تنفيذ أحكام التحكيم التجاري الدولي الأجنبي في الجزائر
Résumé: يعد تنفيذ حكم التحكيم نهاية للخصومة التحكيمية لأن التحكيم لا ينتج آثاره القانونية إلا إذا انتهى إلى حكم وكان هذا الحكم واجب التنفيذ وإلا ظل التحكيم مجرد فكرة قانونية. وعلى هذا الأساس حدد المشرع الجزائري آليات لتفعيل حكم التحكيم التجاري الأجنبي الذي يقضي تنفيذه اختياريا ، غير أنه قد يتقاعس المحكوم ضده للامتثال للحكم التحكيمي طواعية مما يؤدي إلى تنفيذه جبرا. ويمر تنفيذ حكم التحكيم التجاري الأجنبي في الجزائر بعدة مراحل أولهما أن يتم الاعتراف بهذا الحكم متى كان موجودا وغير مخالف للنظام العام الدولي وبعد صدور هذا الأمر يمهر بالصيغة التنفيذية ويصبح حكم التحكيم سندا تنفيذيا واجب التنفيذ داخل اقليم الدولة كما أقر المشرع الجزائري استئناف القاضي بالاعتراف أو التنفيذ لحكم التحكيم الأجنبي وكذا أجار الطعن بالنقض. Summary: The implementation of the arbitral awardisconsidered an end to the arbitral dispute because the arbitration does not produceitslegaleffectsunlessit leads to aruling and thisrulingisenforceable. Otherwise, the arbitration remainsjust a legalidea. On this basis, the Algerian legislator has identifiedmechanisms for activating the foreign commercial arbitration award, whichrequiresitsimplementationvoluntarily. However, the convict mayfail to complywith the arbitral awardvoluntarily, which leads to itsforcibleimplementation.
