تجريم إفشاء السرية المصرفية - دراسة مقارنة-.

Résumé: الملخص: إن جريمة إفشاء السر المصرفي جريمة خطيرة وجد حساسة كونها تمس بحرمة حياة العميل الخاصة، ويظهر ذلك من خلال تمكين المؤسسة المصرفية للغير من معلومات ومعطيات مصرفية تخص العميل الأمر الذي يترتب عليه خرق مبدأ الثقة القائم بينهما، غير أن قاعدة تجريم افشاء السرية المصرفية لا تؤخذ على اطلاقها بل ترد عليها قيود تفرضها المصلحة العامة، هذا ما تفطنت اليه مختلف التشريعات المقارنة بما في ذلك التشريع الجزائري وعمدت على تكريسه سواء بصفة خاصة بموجب قانون خاص بالسرية المصرفية أو بصفة عامة تحت عنوان الالتزام بالسر المهني. Abstract: The disclosing banking secret is a dangerous and sensitive crime considering it affects the sanctity of client’s private life, that is demonstrated by the banking institution providing others with banking information and data related to the client, which results in the violation of the principle of trust existing between them. However, the rule of criminalizing the disclosure of banking secrecy cannot be taken as absolute, but rather it is restricted by the public interest. This is what various comparative legislations; including the Algerian legislation, noticed and decided to enshrine it, whether in particular under a special law on banking secrecy or in general under the title of commitment to professional secrecy.
