المقتضيات الجزائية لمواجهة المسافر الخفي في القانون البحري الجزائري

Résumé: يعتبر التسلل إلى السفن بطريقة غير نظامية أولى صور تجريم الهجرة غير الشرعية في الجزائر، حيث أن المادة 545 من القانون البحري تجرم هذا الفعل وتعاقب عليه ابتداء من سنة 1998، غير أنه بعد استحداث المادة 175 مكرر 01 في تعديل قانون العقوبات سنة 2009، التي تعاقب على مغادرة الإقليم الوطني بصفة غير شرعية بما في ذلك اجتياز الحدود البحرية، نجد أن بقاء جريمة التسرب خلسة في السفينة في نصوص القانون البحري لا جدوى منه، حيث أن المشرع الجزائري بإصداره القانون 09 – 01 المعدل لقانون العقوبات يكون قد أعاد تنظيم موضوع الهجرة غير الشرعية تماشيا مع الالتزامات الاتفاقية للدولة، ناهيك عن التداخل والتعارض بين النصوص المنظمة لنفس الموضوع من حيث الوصف الإجرامي والعقوبات الجزائية، وقد جاء هذا البحث لتسليط الضوء على الاشكالات المترتبة على التجريم المزدوج والعقوبات المتعارضة، سواء بالنسبة للمسافر الخفي أو شركائه، في كل من القانون البحري وقانون العقوبات.
