تخريج الفروع الفقهية على الأصول النحوية - دراسة وصفية تطبيقية -

Résumé: إنّ معاني النصوص من آيات وأحاديث أحكام لا تفهم على صحة إلاّ بتوفيتها حقوقها من الإعراب، وهوما تتولاّه المبادئ النحوية، إذ بها تتبيّن أصول المقاصد بالدلالة، وعليها تتخرّج جملة ليست باليسيرة من المسائل الفرعية التي لا يتبيّن وجه الدلالة من الكثير منها إلا بابتنائها على أصول نحوية، ومعرفتها- أي المبادئ النحوية- شرط لمن تصدّى للإفتاء، وشرط من شروط الاجتهاد؛ فمن لا يهتدي إلى وجه الارتباط بين أحكام الفروع وأدلتها التي من بينها أصول النحو، لا يتسع له المجال، ولا يمكنه التفريع عليها بحال. إنّ فنّ تخريج الفروع الفقهية على الأصول النحوية سليل علم تخريج الفروع على الأصول الفقهية، قد يستقل بذاته عنه كما استقل هو بذاته عن علمي أصول الفقه والفقه؛ فموضوعه إذن موضوعه، وكذا الأركان والشروط، ولا تخفى أهميته على ذي لب.
