المسؤولية الجزائية للصيدلي المرتبطة بالمؤثرات العقلية
Résumé: عرفت المتاجرة بالمؤثرات العقلية رواجا كبيرا في المجتمع الجزائري خاصة من قبل الشباب، نظرا لسهولة الحصول على كميات كبيرة منها والإدمان المستمر عليها ، ودخلت مهنة الصيدلة من قبل بعض الصيادلة في هذا الميدان حيث غيروا الهدف الأساسي لهذه المهنة المتمثل في المحافظة على الصحة العامة وحولوه إلى وصف غير مشروع وهو الربح السريع وجني المال بأي طريقة كانت خصوصا الاتجار بالمؤثرات العقلية. ونظرا لانعكاساتها الخطيرة على مستقبل الشباب الجزائري وأمنه الصحي والاجتماعي والاقتصادي ولما تسببه من أضرار جسيمة، سارع المشرع الجزائري إلى سن ترسانة من النصوص التشريعية والتنظيمية بهدف تسهيل الرقابة على المؤثرات العقلية وتنظيم التعامل المشروع بها وتحميل المسؤولية الجزائية لكل من يخالف هاته النصوص منها الصيدلي. تبرز أهمية الموضوع في التعرف على مسؤولية الصيدلي الجزائية عن تعامله غير المشروع بالمؤثرات العقلية، وتم التوصل إلى أنه بالرغم من الترسانة القانونية ذات العلاقة بتنظيم التعامل المشروع بالمؤثرات العقلية ورقابتها وقمع الاستعمال غير المشروع لها، إلا أنها تبقى غير كافية. Trafficking in psychotropic substances has become very popular in Algerian society especially by young people, due to the ease of obtaining large quantities of them and the constant addiction to them. Illegal, which is quick profit and making money in any way especially trafficking in psychotropic substances. Given their serious repercussions on the future of Algerian youth and their health social and economic security, and the serious damage they cause, the Algerian legislator hastened to enact an arsenal of legislative and regulatory texts with the aim of facilitating the control of psychotropic substances, organizing legitimate dealing with them, and holding criminal responsibility for anyone who violates these texts, including the pharmacist. The importance of the topic in identifying the criminal responsibility of the pharmacist for his illegal dealing with psychotropic substances, and it was concluded that despite the legal arsenal related to regulating and controlling legal dealing with psychotropic substances and suppressing their illegal use, it remains insufficient
