الحماية القانونية للطفل الجانح بين القانون الدولي والتشريع الجزائري -الوساطة نموذج-

Résumé: إن المرحلة العمرية للطفل ذات خصوصية هامة فرضت على الدول إحاطته بجملة من الأحكام والقواعد القانونية التي تضفي عليه الحماية اللازمة لتأهيله وتحقيق مصلحته الفضلى ، وتجسد ذلك في جملة من الإتفاقيات العالمية التي ضمت عديد الدول منها الجزائر والتي تبنت كلها موقفا حمائيا للحدث الجانح ، وهو ما إتجه لتكريسه المشرع الجزائري بموجب القانون رقم 15_12 المتعلق بحماية الطفل ، محاولا بذلك تطويق الطفل عموما ، والحدث الجانح خاصة بحماية قانونية خلال جميع المراحل ، واعتمد في ذلك سياسية تأهيلية ، تجنب الحدث نظام العقاب ، وتجلى ذلك في الأحكام الخاصة بمعاملة الحدث بداية من تحديد المقصود بالطفل ، و تقسيم مسؤوليته طبقا للمراحل العمرية التي يمر بها، بالإضافة لإحاطته بضمانات حمائية خلال مرحلتي التحري والتحقيق على غرار الوساطة الجزائية . The privacy of the child's age has imposed on states to surround him with legal rules that provide him with the necessary protection to rehabilitate him and fulfill his best interests through global agreements that included several countries, including Algeria; and which all adopted a protective stance against juvenile delinquency. In an attempt to surround the child in general and the delinquent juvenile in particular with legal protection during all stages by adopting a rehabilitative policy; the Algerian legislator tended to implement this. By establishing special rules for treating juveniles, starting with determining the intended child and dividing his responsibility according to the age stages he goes through. During the stages of detection and investigation he is surrounded also by protective guarantees
