تخريج الفروع على الفروع عند المالكية من خلال كتاب "الأجوبة" لابن عظوم المرادي The Extraction Of Branches On Branches Trough The Book “ The Answers ” Of Ibn Adhoum Al Moradi

Résumé: يظهر في كل عصر قضايا محدثة لم يسبق معرفة أحكامها، والإمام النّظار مفتقد أو يعز وجوده بعد عصر الأئمة، والمرويّات عنهم قاصرة عن الإحاطة بهذه الأحكام، وفي هذه الحالة يرتكز الفقيه في استنباط الأحكام على آلية عرفت بالتخريج الفقهي، ونجد من أنواعه تخريج الفروع على الفروع، ولإجلاء النظر عن حقيقة هذا الصنف وبيان أهميته جعلت محور هذه الدراسة يدور على تخريج الفروع على الفروع، وخصصته بالمذهب المالكي، واخترت كتاب "الأجوبة" لابن عظوم المرادي نموذجا، واقتضت منهجية البحث أن أعرّف فيها بابن عظوم وكتابه "الأجوبة"، وتخريج الفروع على الفروع، وعني بدراسة شروط مجتهد التخريج، وحكم نسبة القول المخرج إلى الإمام، والعمل به في الفتوى والقضاء، وتخريج الفروع على الفروع من خلال كتاب "الأجوبة"، مع سياق نماذج عملية. In every era, it appeared that the rules of the up dated issues were not known previously, and Imam Al-Nathar his existence was missing after the age of the Imams, and the narratives were unable to over all these rules, and in this case the jurisprudent stressed in deducing them on a mechanism known as the jurisprudence extraction, and we find among its kinds extraction of branches on branches and in order to spot light the truth of this type and exhibition of its importance, I had made the focus of this study about the extraction of the branches on the branches, and I specified it by the Maliki doctrine (Rite), and I had chosen the book of "The Answers" of Ibn Adhoum Moradi as amodel, and the research methodology required to know him and his book "The Answers", and the extraction of branches on branches, and emphasized by the study of reasoning’s proportions and the percentage of the rule of the extracted speech and the work by it in the advisory opinion and the judiciary, and the extraction of the branches on the branches through the book of "The Answers", with the inclusion of practical models.
