التغيرات المناخية المنتهكة لحقوق الإنسان المترتبة عن الإخلال بقواعد القانون الدولي الإنساني

Résumé: يطرح الاستخدام العسكري للأسلحة سواء التي شملها نطاق الحظر الاتفاقي الدولي أوالتي لم يشملها، إشكالية دولية تترتب عنها تقنيات التغيير في البيئة عن طريق التأثير المعتمد في العمليات الطبيعية، من ديناميكية الكرة الأرضية أو تركيبتها أو تشكيلتها، بما في ذلك مجموعات أحيائها المحلية وغلافها الصخري و المائي و الجوي، أو في ديناميكية الفضاء الخارجي أو تركيبته أو تشكيلته. و التي تقترن بتغيرات مناخية تنتهك التمتع الفعلي لمجموعة من حقوق الإنسان الأساسية، كالحق في الحياة والصحة، و الحق في البيئة النظيفة، التي تشكل جزءا من جملة حقوق الإنسان محل الحماية في الصكوك والمواثيق الدولية. Abstract: The military use of weapons, whether covered by the scope of the international convention ban or not, poses an international problem that results in techniques for changing the environment through the adopted influence on natural processes, from the dynamics of the globe, its composition or formation, including the groups of its local neighborhoods and its lithosphere and water and air, or the dynamics, composition, or formation of outer space. And that is associated with climate changes that violate the actual enjoyment of a set of basic human rights, such as the right to life and health, and the right to a clean environment, which are part of the human rights protected in international instruments and charters.
