المركز القانوني للنيابة العامة أمام المحاكم التجارية المتخصصة

Résumé: على ضوء الأمن الاِقتصادي الذي تشهده الجزائر كغيرها من دول العالم قد أدى إلى ظهور معاملات تجارية نوعية ينبغي النظر فيها من طرف جهات قضائية متخصصة، لذا عمدَ المشرع الجزائري باستحداث محاكم تجارية متخصصة في القضايا ذات الطابع التجاري وجعل للنيابة العامة مركز قانوني لدى هذه المحاكم. وعلى هذا الأساس عالجت ورقـتـنا البحثية موضوع المركز القانوني للنيابة العامة أمام المحاكم التجارية المتخصصة حيث كشفت الدراسة المكانة الحقيقية للنيابة العامة لتدخلها في القضايا المعروضة أمام المحكمة التجارية المتخصصة والتي عَرَفـت اِختلاف فقهي حول دورها أمام هذه المحاكم بين اِتجاه مؤيد ومعارض، واِنتهت الدراسة إلى تحديد اختصاص النيابة العامة أمام المحاكم التجارية المتخصصة وأهم صعوبات تدخلها في القضايا المعروضة أمام المحاكم التجارية المتخصصة. In light of the economic security witnessed by Algeria, like other countries of the world, it has led to the emergence of qualitative commercial transactions that must be considered by specialized judicial bodies, so the Algerian legislator has created commercial courts specialized in cases of commercial nature and made the Public Prosecution a legal center with these courts. On this basis, our research papers dealt with the subject of the legal center of the Public Prosecution before the specialized commercial courts, where the study revealed the true position of the Public Prosecution for its interference in the cases before The public is in front of specialized commercial courts and the most important difficulties of their interference in the cases before the specialized commercial courts.
