الألعاب الرياضية بين الإباحة والتجريم

Résumé: إن الألعاب الرياضية بوجه عام، وكرة القدم بوجه خاص، قد انتقلت من كونها رياضة شعبية إلى ظاهرة عالمية، لهذا تخضع ممارسة الألعاب الرياضية لبعض الضوابط والشروط التي تكفل عدم انحراف الرياضة عن الأهداف المنوطة بها حتى ولو كانت بعض الرياضات تتطلب درجة معينة من العنف مثل الملاكمة إلا انه لابد من مراعاة قواعد اللعبة، فيشكل الإخلال بالشروط أو الضوابط جريمة جنائية، يقع مرتكبها تحت طائلة العقاب الجزائي، ومن هنا بدأت معظم الدول في استخدام سلاح التجريم والعقاب ضد بعض الممارسات مثل العنف في الملاعب الرياضية، استعمال المنشطات الرياضية وغيرها من الجرائم الرياضية، ولعل خير دليل على ذلك هو قانون 13/05 المتعلق بتنظيم الأنشطة البدنية والرياضية وتطويرهما، حيث جاء المشرع الجزائري في الباب الرابع عشر ونص على مجموعة من الجرائم اصطلح على تسميتها بالمخالفات . Sports games in General, and football in particulaire, have moved from being a popular sport to a global phenomenon , Therefor, the practice of sports is subject to some controls and conditions that ensure that sport does not deviate from the objecives entrusted to it , even if some sports require a certain degree of violence , such as boxing ,but the rules of the game must be observed, violaton of the conitions or control is a criminal offense, the perpetrator of which falls under penalty of criminal punishment, and from hare most countries began to use the weapon o criminalization and punisment against some practices such as violence in stadiums sports,the use of sports crimes, and perhaps the best evidence for this is law 05/13 related to organizing and developing physical and sporting activities , as the algerian legislator came in chapter fourteen and stipulated a group of crimes termed as violations of words .
