ضوابط تنفيذ الأحكام الأجنبية في الجزائر

Résumé: ملخص: أن تنفيذ الاحكام لا يقتصر على تلك الصادرة عن الجهات القضائية الوطنية بل يمتد الى تنفيذ الأحكام الصادرة عن جهات قضائية أجنبية , وقد عمل المشرع الجزائري على غرار باقي التشريعات الأخرى عند تنظيمه لمسألة تنفيذ الاحكام القضائية الأجنبية الى التوفيق بين اعتبارين الأولى الحاجة الى المعاملات الدولية والمحافظة على مصالح الأفراد والأخرى المحافظة على سيادة الدولة الجزائرية. إن الاحكام القضائية الأجنبية تقبل التنفيذ أمام القضاء الجزائري وفق شروط معينة وتخضع هذه الأحكام الى الرقابة , الغاية منها التحقق من خلو هذه الأحكام من العيوب الجوهرية التي تعيق تنفيذها في الجزائر وفق ما نص عليه قانون الإجراءات المدنية والإدارية ويتم ذلك عن طريق دعوى الأمر بالتنفيذ حيث أن مضمون هذا الحكم لا يمكن أن يأخذ الا أحدى الصورتين الأولى وهي منح الأمر بتنفيذه والثانية تتمثل في رفض منح الأمر بتنفيذ هذا الحكم The implementation of judgmentsis not limited to thoseissued by national judicialauthorities but extends to the implementation of judgmentsissued by foreignjudicialauthorities.
