نطاق اختصاص المحكمة الدستورية في ممارسة رقابة المطابقة ورقابة الدستورية في ضوء التعديل الدستوري لسنة 2020

Résumé: ملخص: إن المحكمة الدستورية من أهم الأجهزة القضائية في أي نظام قانوني، وعلى هذا الأساس خصها التعديل الدستوري الجزائري لسنة 2020، بمجموعة من الصلاحيات المحددة بشكل واضح ودقيق، اذ تمارس هذه الأخيرة الرقابة الدستورية اذا تعلق الأمر بالقوانين العادية قبل اصدارها والمعاهدات قبل المصادقة عليها، ويمارس كرقابة لاحقة اذا تعلق الأمر بالتنظيمات وذلك خلال شهر من تاريخ نشرها، لفحص مدى عدم تعارضها مع الدستور، بينما تنصب رقابة المطابقة على القوانين العضوية، النظام الداخلي لغرفتي البرلمان، الأوامر التشريعية. كلمات مفتاحية: المحكمة الدستورية، رقابة المطابقة، رقابة الدستورية، التعديل الدستوري لسنة 2020. Abstract: The Constitutional Court is one of the most important judicial bodies in any legal system, and on this basis, the Algerian constitutional amendment of 2020, singled it out with a set of clearly and precisely defined powers, as the latter exercises constitutional control when it comes to ordinary laws before their issuance and treaties before ratification, and it is exercised as oversight Subsequent if it comes to regulations, within a month from the date of their publication, to examine the extent to which they do not conflict with the constitution, while the control of conformity is focused on organic laws, the internal regulations of the two chambers of Parliament, and legislative orders.
