ضمانات تفعيل مبدأ مجانية التعامل بالأعضاء و الأنسجة والخلايا البشرية في ظل قانون الصحة 18-11

Résumé: لضمان تطبيق مبدأ مجانية نقل وزرع الأعضاء والأنسجة والخلايا البشرية، والاعتراف باستقلالية التعامل في جسم الإنسان، ولتحقيق نزاهة التعامل القانوني بالأعضاء والابتعاد تماما من نطاق المتاجرة بالأعضاء وعناصره ومنتجاته ،نص المشرع الجزائري في ظل قانون الصحة رقم 18-11 على مجموعة من الشروط القانونية اللازمة لتفعيل هذا المبدأ والتي تتمثل في شرط السرية، القرابة، حظر الدعاية الشخصية والإعلانات، مع وجوب إجراء هذه العمليات في المؤسسات المرخص لها. كما تم إدراج عقوبات جزائية صارمة تسلط على كل من يخالف هذه الأحكام، وتمنع أي ابتزاز مادي قد يقع على المتبرع في عمليات نقل الأعضاء أو الأنسجة أو الخلايا البشرية. To guarantee the application of the principle of free transfer and free transplantation of human organs, tissues and cells, as well as the recognition of the independence of the treatment of the human body, to ensure the integrity of the legal treatment of organs and to remain completely outside the scope of the trade in organs, their components and their products, the Algerian legislator has stipulated within the framework of the health law n° 18-11 a set of legal conditions necessary for the activation of this principle which results in the requirement of confidentiality, kinship and the prohibition of advertising and personal announcements, with the need to carry out these operations in approved establishments. Severe criminal penalties have also been provided for anyone who violates these provisions, and any material extortion that may accrue to the donor during the transfer of human organs, tissues or cells is prohibited.
