الضمانات القانونية لعمليات نزع وزرع الأعضاء البشرية بين الأحياء في ظل القانون رقم 18-11 المتعلق بالصحة (المعدل والمتمم)

Résumé: تهدف هذه الورقة البحثية دراسة الضمانات القانونية لتأمين عمليات نزع وزرع الأعضاء والأنسجة والخلايا البشرية، طبقا للقانون رقم 18 – 11 المؤرخ في 02 يوليو 2018 المتعلق بالصحة، وخلصت الدراسة إلى أن هذه الضمانات يمكن تقسيمها إلى ضمانات عامة تتعلق بالعملية بحدّ ذاتها، حيث يتوجّب أن تكون مشروعة تخضع لمبادئ المجانية، السرية، ومراقبة الدولة، هذا من جهة، ومن جهة أخرى، هناك ضمانات خاصة تتعلّق بأطراف العملية وهما المتلقي (المريض) والمتبرع، حيث يتوجّب أن يتوفر فيهما شرط الرضا الصريح والحر والمستنير أو المتبصر، شرط الأهلية القانونية، وشرط الأمن الصحي The objective of this study was to demonstrate the legal guarantees to secure the operation of removal and transplantation of human organs, tissues and cells, in accordance with law n ° 18-11 of July 02, 2018 relating to health. This study concluded that such safeguards are manifold; they can be divided into general guarantees and specific guarantees: General guarantees are linked to the process itself, which should be legitimate subject to the principles of gratuity, confidentiality and State control. The specific guarantees are linked to the parties to the process, namely the recipient (the patient) and the donor, who must meet the condition of express, free and informed consent, legal capacity, and health security conditions.
