مفهوم الأمن و السلامة في قانون حماية المستهلك و المرسوم التنفيذي رقم 12-203 المتعلق بأمن المنتوجات

Résumé: ملخص: جاء الإلتزام بضمان أمن المنتوجات وسلامتها الذي أقره القانون رقم 09-03 المتضمن قانون حماية المستهلك وقمع الغش، ليضمن الحماية القانونية للمستهلك من أضرار المنتوجات التي تسببها حوادث الإستهلاك، وجاء المرسوم التنفيذي رقم 12-203 المتعلق بأمن المنتوجات ليفصّل في الأحكام المتعلقة بالأمن، حيث يدور موضوع هذا البحث حول مدى فعالية القواعد المتعلقة بأمن وسلامة المستهلك وذلك بالبحث في أحكام ضمان أمن وسلامة المستهلك المكرسة بموجب قانون حماية المستهلك وتلك التي نص عليها المرسوم التنفيذي المتعلق بأمن المنتوجات. إنّ مفهوم الأمن والسلامة في قانون حماية المستهلك يتميز بالتفرد عن مفهوم السلامة المعروف في القواعد العامة، كما يميل المرسوم التنفيذي رقم 12-203 المتعلق بالقواعد المطبقة في مجال أمن المنتوجات، لتصبح أكثر صرامة لضمان حماية أكبر للمستهلك. The commitment to ensure the security and safety of products, approved by Law No. 09-03 containing the Law on Consumer Protection and Suppression of Fraud, came to ensure legal protection for the consumer from product damage caused by consumption accidents, and the executive Decree No. 12-203 on product security elaborates on the provisions on security, where the subject of these research revolves around the effectiveness of the rules on consumer security and safety, by examining the provisions to ensure the security of consumer safety enshrined in the Consumer Protection Law, and those provided for in the executive decree on product security. The concept of security in the Consumer Protection Law is distinguished by the uniqueness of the concept of safety known in the general rules, and the rules of Executive Decree No. 12-203 on the rules applicable in the field of product security also tend to become stricter to ensure greater consumer protection.
