الحماية القانونية للطفل من مخاطر وسائط الاعلام الجديدة في التشريع الجزائري -مقاربة نظرية -

Résumé: تناولت هذه الدراسة موضوع الحماية القانونية للطفل من مخاطر وسائط الاعلام الجديدة في التشريع الجزائري، حيث انها تقدم الكثير من المزايا والخدمات المعرفية والترفيهية لمستخدميها، وبالنسبة للأطفال فهي توفر فرصا عدة في مجال التعلم، التواصل والألعاب والتسلية، لكنها قد تكون ذات اثار سلبية ذلك انها باب مفتوح على مختلف الاحداث والشخصيات، أما على الصعيد القانوني والتنظيمي، لم يخف على مختلف التشريعات الحديثة التصدي لهذا الأمر من أجل حماية الطفل وفي هذا السياق، خص المشرع الجزائري في ظل القوانين الحديثة توفير الحماية للطفل في القانون رقم 15-12 المؤرخ في 15 جويلية 2015 المتعلق بحماية الطفل، كما مسه بالحماية في نصوص متفرقة أخرى تضمنتها أحكام مختلف القوانين سواء المتعلقة بقانون الإعلام، القانون المتضمن القواعد الخاصة للوقاية من الجرائم المتصلة بتكنولوجيات الإعلام والاتصال ومكافحتها، القانون المتضمن القانون التوجيهي للتربية الوطنية، وكما أوجد هيئات مختلفة وسلطات ضبط تعمل على مراقبة خدمات الاتصال، ومقدمي ومزودي هذه الخدمات، أو مراقبة الاتصالات الإلكترونية، كما أولى أهمية للحماية قضائية للطفل الجانح بما فيها مرتكبي الجرائم المتصلة بالإعلام والاتصال، في ظل القوانين الإجرائية أو قانون العقوبات أو قانون حماية الطفل، وهذه الورقة البحثية ستلقي الضوء على الآثار السلبية لاستعمال وسائط الاعلام الجديدة عند الطفل مع الآليات القانونية لتوفير الحماية للطفل من مخاطر وسائط الاعلام الجديدة من خلال رؤية قانونية في التشريع الجزائري من خلال مقاربة نظرية. This study dealt with the issue of legal protection of the child from the dangers of the new media in the Algerian legislation, As it provides many advantages and cognitive and entertainment services to its users, and for children it provides several opportunities in the field of learning, communication, games and entertainment, but it may have negative effects because it is an open door to various events and personalities, As for the legal and organizational level, it was not hidden from the various modern legislations to address this matter in order to protect the child , In this context, the Algerian legislator singled out, in light of modern laws, the provision of protection for the child in Law No. 12-15 of July 15, 2015 related to child protection, It also affected it with protection in other separate texts included in the provisions of various laws, whether related to the media law, The law that includes special rules for preventing and combating crimes related to information and communication technologies, the law that includes the guiding law for national education, It also established various bodies and control authorities that monitor communication services, the providers and suppliers of these services, or control electronic communications, It also attached importance to the judicial protection of the delinquent child, including the perpetrators of crimes related to information and communication, in light of the procedural laws, the penal code, or the child protection law. This research paper will shed light on the negative effects of the use of new media on children with legal mechanisms to provide protection for children from the dangers of new media through a legal vision in Algerian legislation through a theoretical approach.
