مكانة الشريعة الإسلامية بين النظم القانونية الغربية من خلال " شهادات ومواقف أجنبية "

Résumé: الدلخص : سأتناول في ىذا الدقال مكانة الشّريعة الإسلامية بين النّظم القانونية الوضعية الغربيّة لا عن طريق عرض مزايا وخصائص الشّريعة الإسلامية ، بل من خلال عرض شهادات لعلماء متخصصين في الدّراسات القانونيّة ، و مواقف صادقة تعبر عن التقدير الكبير للفقو الإسلامي وتنفي عنو ما رماه بو بعضهم من الجمود والتخلف ، وعدم القدرة على مواكبة التطورات فضلا عن مضارعة التشريع القانوني الحديث ، مؤيدين ذلك بذكر قرارات بعض الدؤسسات الغربية تشيد فيو بالتقدير والإعجاب بما لػتويو الفقو الإسلامي من نظريات ومبادئ راقية تضارع نظ ريات ومبادئ الفقو الغربي ، منتهيا بكلمة عن مستقبل ىذا الفقو ومكانتو التي لغب أن لػتلّها . abstract I will present in this article the status of “islamic law” Between the Western legal systems position ,not by presenting the advantages and the characteristics of “islamic law ” , But by showing the testimonies of scholars who were specializing in the legal studies,and honest attitudes that Expresses a great appreciation of Islamic jurisprudence and denies from it the stagnation and the underdevelopment,and the inability to keep up with the Modern legal legislation,supporting that by mentioning some Western institutions decisions that Commends on it with appreciation and admiration of what the Islamic jurisprudence contains of theroies and upscale principles that goes parallel with the theories and principles of Western jurisprudence. Ending with the future of this doctrine and its status that must be occupied.
