تقييم دور الهيئة العليا المستقلة لمراقبة الانتخابات في الجزائر

Résumé: إن فاعلية الرقابة على العملية الانتخابية تحتاج لوجود هيئة تتمتع بالاستقلالية العضوية والوظيفية تتولى ممارسة هذه الوظيفة، وفي هذا السياق أستحدث المؤسس الدستوري هيئة عليا تتولى مراقبة الانتخابات بموجب المادة 194 من التعديل الدستوري لسنة 2016 واعترف لها بالاستقلالية، لكن بالرجوع لهذه المادة وفحصها وتحليل مواد القانون العضوي 16/11 المتعلق بها،نجد أن فاعلية الدور الرقابي لهذه الهيئة تقف في وجهه بعض العوائق من ناحية كيفيات تشكيل الهيئة وهو ما يمثل الجانب العضوي،ونقص فاعلية دورها الوظيفي في عملية الرقابة على العملية الانتخابية،وهذا ما ستتمحور حوله ورقتنا البحثية للوقوف على النقائص ومحاولة إيجاد حلول لها من أجل تدعيم الدور الرقابي للهيئة العليا المستقلة لمراقبة الانتخابات. The effective monitoring of the electoral process needs an independent institution to exercise this function. In this context, the constituent power set up a high institution to monitor elections under the article 194 of the amended constitution of 2016 and recognized its independence. However, by reference to this article, and the examination and the analysis of the organic law 16/11,we noticed that the effectiveness of the supervisory role of this institution faces certain obstacles in terms of its composition or the membership side, and the lack of effectiveness of its role in the supervision of the electoral process. This is what our research paper is about, by focusing on shortcomings and trying to find solutions in order to strengthen the supervisory role of the Independent High Electoral Institution.
