Résumé: يترتب عن الجانب الإجرائي لاتفاق التحكيم كونه تصرف قانوني اثرين أحدهما أثر إيجابي وهو ثبوت اختصاص قضاء التحكيم يتمثل في منح الاختصاص للهيئة التحكمية للنظر في موضوع النزاع ، والثاني أثر سلبي هو سلب النزاع من سلطة ولاية القضاء وحرمان أطراف العقد من اللجوء إلى القضاء العادي بشأن النزاع الذي وقع الاتفاق على حله عن طريق التحكيم.
