Résumé: إذا كان الأثر السلبي لاتفاق التحكيم يتمثل في إبعاد قضاء الدولة عن النظر في النزاع المتفق في شأنه على التحكيم ، فان أثره الايجابي و على العكس من ذلك يتمثل في تقديم ضمانات لهيئة التحكيم للنظر في جميع المنازعات التي تدخل في نطاق اتفاق التحكيم ، لذلك يتعين تجسيد ضمانات قانونية للهيئة التحكيمية حتى يمكن ترتيب الأثار القانونية لاتفاق التحكيم . ولا يتوقف نجاح القوانين المؤطرة للتحكيم التجاري ، على تفعيل الحرية الممنوحة للأطراف في اللجوء إلى التحكيم أو اختيار محكميهم ، بل يلعب قضاء الدولة دورا هاما في تسهيل مهمة هيئة التحكيم و تمكينها من أداء عملها بالفصل في النزاع المطروح عليها في أقصر وقت و بأبسط الإجراءات . If the negative effect of the arbitration agreement is to exclude the jurisdiction of the State from the consideration of the dispute agreed upon in arbitration, its positive effect, on the contrary, is to provide guarantees to the arbitral tribunal to consider all disputes within the scope of the arbitration agreement, Of the arbitral tribunal so that the legal effects of the arbitration agreement can be arranged. The success of the laws under commercial arbitration does not depend on activating the freedom granted to the parties to resort to arbitration or choosing their arbitrators. The state courts play an important role in facilitating the task of the arbitral tribunal and enabling it to perform its duties by adjudicating the dispute in the shortest time.
