الحماية الجزائية للمصنفات الرقمية في التشريع الجزائري.

Résumé: ملخص: تعتبر المصنفات الرقمية أحد أهم منتجات عصر الرقمنة، الذي أدى إلى ظهور عدة تحديات، أهمها تكييف الترسانة القانونية بما يحقق أفضل حماية لهذه المصنفات، إذ سارع المشرع الجزائري من خلال تشريعاته إلى سن قواعد وأحكام خاصة لحماية هذه المصنفات الرقمية، التي تتعدد أنواعها إلى برامج حاسوب وقواعد بيانات وغيرها من المصنفات دون إمكانية حصرها، والتي يستوجب لحمايتها توفر عدة شروط كالأصالة والتجسيد المادي،إضافة إلى إجراء قانوني يتمثل في ايداع المصنف لدى الجهات المختصة؛ ومن أهم ما أقره المشرع الجزائري من نصوص جزائية ما ورد في الأمر رقم: 03-05 المتعلق بحقوق المؤلف والحقوق المجاورة، أين اعتبر جل أشكال التعدي على المصنفات الرقمية تتخذ وصف جنح تقليد، إضافة إلى أحكام أخرى تضمنها القانون رقم: 04-15 المعدل والمتمم لقانون العقوبات، وذلك بموجب فصل خاص مكرر تضمن جرائم المساس بأنظمة المعالجة الألية للمعطيات، والتي تتخذ هي الأخرى عدة صور من شأنها أن تشكل انتهاك لحقوق المؤلف على مصنفاته الرقمية؛ إلا أن هذه القواعد تبقى قاصرة نظرا لعدم توسع المشرع الجزائري في مجال حماية المصنفات الرقمية. :Summary Digital works are considered one of the most important products of the era of digitization, which led to the emergence of several challenges, the most important of which is the adaptation of the legal arsenal in order to achieve the best protection for these works, as the Algerian legislator, through its legislations, rushed to enact special rules and provisions to protect these digital works, which vary in type to computer programs And databases and other works without limitation, for which protection requires several conditions such as originality and material embodiment, In addition to a legal procedure represented in depositing the work with the competent authorities; Among the most important of what the Algerian legislator approved from the penal texts is what was mentioned in Ordinance No. 03-05 related to copyright and related rights Where was it considered that most forms of infringement of digital works take a description of counterfeiting misdemeanors, in addition to other provisions included in Law No. 04-15 amending and supplementing the Penal Code, according to a repeated special chapter that includes the crimes of prejudice to the automated data processing systems, which also take several forms of Although it constitutes a violation of the copyright of his digital works, however, these rules remain limited due to the lack of expansion in the Algerian legislature in the field of protection of digital works.
