Résumé: الحماية القانونية للمصنفات الرقمية في الأمر رقم 03-05 من التشريع الجزائري ملخص : إن التطور الهائل في المجال التكنولوجي والذي وصل قمته بوجود شبكة الانترنت، حيث أثر ذلك على عملية إبداع المصنفات وكذلك على المفهوم التقليدي لها، وهو الأمر الذي تجسد بظهور شكل جديد من المصنفات توصف بالرقمية، وهي عديدة ومتنوعة، ومتى ما وجدت هذه المصنفات وظهرت فإنها تثبت حقوقا أدبية ومالية لمؤلفيها، ومن هنا تبرز أهمية حماية الإنتاج الفكري بالنسبة لمؤلفي هذه المصنفات الرقمية، لذلك أقر لها المشرع الجزائري حماية قانونية بموجب قانون حق المؤلف، إذا ما توفرت شروط معينة. Legal protection of digital works in Order No. 03-05 of Algerian legislation Abstract: The enormous technological development that has come to the fore with the presence of the Internet has had an impact on the process of creating works as well as on the traditional concept of them, This is reflected in the emergence of a new form of digital classification, which is numerous and diverse, When such works are found and appear, they establish moral and financial rights for their authors, Hence the importance of protecting intellectual production for the authors of such digital works, The Algerian legislature has therefore granted them legal protection under the Copyright Act, if certain conditions are met.
