تقصي الاستحداث في أحكام المواريث-من تأويل النص الشرعي إلى مآل النص الفقهي–

Résumé: تُعنى هذه الدراسة بالبحث في حقيقة أحكام المواريث بين اتفاق واختلاف الفقهاء فيها وتأويل النص الشرعي المتعارف عليه, وبين محاولات دعاة الاستحداث إلى إعطاء تأويلات جديدة وسن قوانين مغايرة للإرث, تكفي في نظرهم لاستيعاب وحل المشاكل العملية التي يعاني منها فقه المواريث ولقد تطرقت هذه الدراسة إلى بعض أوجه اختلاف و اتفاق الفقهاء في أحكام المواريث و بيان أهم أسباب هذا الاختلاف كما تضمنت بيان أهم المسائل المستحدثة وأسباب القراءة المعاصرة والتجديد في أحكام المواريث انطلاقا من إعادة تأويل النص الشرعي The means the study in the face the provisions of inheritance among agreement and difference of the Scholars and the interpretation of the text legitimate of the customary and between the attempts to advocates of development aimed at giving new interpretation and enactment of difference laws of inheritance enough in their view to accommodate and solving the practical problems suffered by the jurisprudence of the inheritance, has touched on this study to some difference and the agreement of the Scholars in the provisions of inheritance and the statement of the most important reasons for this difference also included a statement of the most important issues developed and the causes of contemporary reading and renovation in the provisions of inheritance from the interpretation of the legitimate text
