أحكام الوصية في القانون الجزائري

Résumé: يعتبر المال والبنون زينة الحياة الدنيا، لأنهما الركيزة الأساسية للفطرة ، لهذا جاءت الشريعة لتستجيب لتحقيق حق الامتلاك وعدم التعدي عليه، وبالمقابل يسمح بانتقال الأموال بالطرق المشروعة عبر سبل انتقال المال ما بعد الموت، فإذا مات الإنسان فإن الحقوق المالية تنتقل منه الى الأحياء المتمثلين في فروع الميت أو أقربائه باعتبارهم امتداد مادي للإنسان نفسه، وتتشكل أحكام انتقال المال من الميت إلى الحي في مجموعها أحكام الميراث وأحكام الوصية، فالميراث بمعنى توريث ما يتركه الميت من مال لأهله وفق ترتيب معين والوصية أيضا تكون بالمال وهي التبرع به بعد الموت مما يجوز به الإيصاء به شرعا. الكلمات المفتاحية: المال، الامتلاك، الميراث، الوصية.
