الحماية الجزائية لبراءة الاختراع في ظل التشريع الجزائري

Résumé: صاحب التقدم العلمي والتكنولوجي خلال القرن العشرين حدوث تغيرات اقتصادية هائلة وذلك بالتدفق الكبير للإنتاج وزيادة حركة المبادلات التجارية، الأمر الذي أدى إلى الاهتمام بالاختراعات التي أصبحت أساس التطور العلمي والتكنولوجي، وبهذا فقد تمت حماية هذه الاختراعات عن طريق منح براءات الاختراع لأصحابها، وبالتالي استفادتهم من حق الاستئثار باستغلال هذه الاختراعات دون غيرهم، غير أن هذه الحماية الممنوحة لهم قد تنتهك من طرف الغير عن طريق تقليد الاختراع، والتي تعتبر جريمة، لهذا خص المشرع الجزائري مالك براءة الاختراع بحماية جزائية للتصدي للاعتداءات الخاصة بالجرائم ضد الحقوق الإستئثارية التي يملكها والتي تنشأ عنها جرائم دعاوى جزائية والتي تشمل كافة الأفعال المكونة لجريمة تقليد الاختراع، ومنها ما يشكل جرائم ملحقة بجريمة التقليد، وهذا من خلال سنه لمجموعة من النصوص القانونية تحمي أصحاب الاختراع واختراعاتهم. Scientific and technological progress during the twentieth century was accompanied by tremendous economic changes, with the large flow of production and the increase in the movement of trade exchanges, which led to interest in inventions that became the basis of scientific and technological development, and thus these inventions were protected by granting patents to their owners, and thus benefited from the right of Excluding the exploitation of these inventions without others, but this protection granted to them may be violated by others by imitating the invention, which is considered a crime. For this reason, the Algerian legislator singled out the owner of the patent with a penal protection to address the attacks of crimes against the exclusive rights he owns and that result in lawsuits crimes Penal, which includes all acts constituting the crime of counterfeiting the invention, including what constitute crimes attached to the crime of counterfeiting, and this is through the enactment of a set of legal texts that protect the owners of inventions and their inventions.
